CLIENT (40 YEAR OLD FEMALE) vs. DEFENDANT (16 YEAR OLD MALE-non commercial)

Plaintiff's Attorney: Robert H. Pedroli, Jr.

Type of Claim: two vehicle collision at intersection regulated by stop sign on Route 100, west of Clarkson and east of Route 109. The accident occurred in December, 2005. Plaintiff claimed the defendant ran a red light and struck her vehicle while she was making a left turn on a left green arrow. Defendant did not admit liability, claimed comparative fault but admitted that he entered the intersection on a red light as he was distracted with his car stereo.

Defendant disputed the nature and extent of plaintiff's alleged injuries. Defendant asserted that some of plaintiff's treatment was unnecessary and some of the treatment was unrelated to the collision.

Damages/Injuries Alleged: neck and back injury, brain stem contusion, injury to the thoracic outlet region and to the elbows. Plaintiff underwent pain injections with Dr. H. G. Tad Berry, M.D. Plaintiff underwent bilateral thoracic outlet surgery and elbow nerve release surgery with Dr. Susan MacKinnion, M. D. Plaintiff treated with various neurologists and orthopedic physicians. Her brain stem contusion resolved in about six months. Her other symptoms were significantly improved by the surgeries. She complained of only intermittent problems currently. There were no lost wages. Plaintiff's medical bills were approximately $128,000.00.

Plaintiffs Experts: Dr. Susan MacKinnion, M.D., and Tad Berry, M.D., both treating physicians.

SETTLEMENT: The case settled at mediation for total compensation of $270,000.00. The case was set for trial and all depositions were completed. The mediation was ordered by the court and was completed after the case was continued from a trial setting. Defendant's insurance policy limits were $300,000.00.
