Of Claim: While traveling east on I-64 in Chesterfield
client slammed on brakes and swerved to avoid traffic control worker
who ran onto the highway to place a construction traffic warning sign in the inside lane, near
Boones Crossing.
Damages: Non-displaced fracture of thumb and cut on forehead
about 1 1/2" with small residual scar. Client underwent laceration
closure in emergency room by plastic surgeon. Accident occurred one
week before plaintiff's wedding and honeymoon.
Medical Bills:$4,100
Total Settlement:$141,600
Comment: The plaintiff's scar was most pronounced at the time of her wedding and she had to alter her hair style to try to hide the scar. We effectively argued that a jury, especially the female members, would certainly understand the affect that this injury had on the plaintiff. The wedding was relatively large and involved many out of town guests.
